Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under Sections 25 (1-b)a and 35 of the Arms Act.

As per the prosecution case, one country-made pistol and two live cartridges were recovered from the house of the petitioner. On interrogation, the wife of the petitioner told that the said pistol belonged to his husband.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.17145 of 2022(2) dt.22-07-2022 2/2 the petitioner is innocent and he has falsely been implicated in this case. The petitioner is accused in one more criminal case as stated at para of the bail petition.

The petitioner is in custody since 18.01.2022. Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitting that the said recovery was made from the conscious possession of the petitioner. Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special C.J.M, Aurangabad, Bihar in connection with Barun P.S. Case No. 129 of 2021.

The application stands allowed.
