The petitioner is in custody since 24.04.2018 in connection with Nawanagar (Sonveresa) P.S. Case No. 42 of 2018 / G.R. No. 894 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case 43 liters liquor was seized. The petitioner is in custody in this case since 24.4.2018. Learned counsel for the petitioner further submits that the seizure was made from the clinic of Dr. Anil Singh, a busy public place and not from the conscious possession of the petitioner. He submits that on

Patna High Court Cr.Misc. No.39720 of 2018(2) dt.09-07-2018 2/2 similar circumstance other co-accused namely Bisram Singh has been granted bail by this Court in Cr. Misc. No. 32944 of 2018 vide order dated 04.06.2018.

Considering the aforesaid fact that similar circumstance co-accused of this case has already been granted bail by this Court in Cr. Misc. No. 32944 of 2018 vide order dated 04.06.2018, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge IIcum- Special Judge, Excise Act, Buxar in connection with Nawanagar ( Sonversa) P.S. Case No. 42 of 2018/ G.R. No. 894 of 2018.
