Since compassionate appointment is not a constitutional or statutory right but flows from certain policy in vogue, keeping in view the facts and circumstances, which led to the passing of the order of rejection of the claim of the petitioner vide Annexure-4, the Court would not like to interfere with the same as it does not suffer from any kind of arbitrariness. The Court further would like to observe that compassionate appointment is not meant for appointing otherwise unemployable siblings, who are well past even their employable age.
Patna High Court CWJC No.8238 of 2016 dt.15-11-2016 2/2 In the present case both the parents are/ were government servants.
