The petitioner apprehends his arrest in Vidyapati Nagar P.S. Case No. 87 of 2014 registered under section 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
Ramsundar Sah the father of Puja Kumar, the wife of the petitioner lodged the case. It is alleged that the petitioner demanded dowry and solemnized second marriage. Learned counsel for the petitioner submits that the petitioner has not solemnized second marriage. The allegation is false and petitioner is ready to keep his wife. Considering the facts and willingness of the petitioner, the above named petitioner is directed to surrender in
Patna High Court Cr.Misc. No.32822 of 2014 (2) dt.03-02-2015 2/2 the court below within a period of four weeks from the date of receipt/production of a copy of this order and the court below shall enlarge the petitioner on provisional bail for a period of two months on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shrii K.D. Ratadee, J.M. Ist Class, Dalsingsarai, Samastipur in Vidyapati Nagar P.S. Case no. 87 of 2014. Thereafter the learned court below shall issue notice to the wife of the petitioner for her appearance and shall make all effort to amicably settle the dispute and if the petitioner keeps his wife, the provisional bail granted to the petitioner shall be confirmed. If the dispute is not amicably settled the learned court below shall pass order in accordance with law on its own merit.
