JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 308 of 2017 for the offences punishable under Sections 328 and 379 of the Indian Penal Code. According to the informant while he was coming from Delhi and had got down at Siwan Railway station, one person had given some cash in handkerchief to him, whereafter he became unconscious and the said person snatched away his money and mobile. It has been further alleged that subsequently, while the informant was going somewhere, he saw the petitioner herein and identified him as the same person, who had handed over hand kerchief to him and cheated him. On such accusation an FI|R was lodged on 6.6.2017 for the occurrence dating back to 9.5.2017.
Patna High Court Cr.Misc. No.49679 of 2017 (2) dt.17-10-2017 2/2 The learned counsel for the petitioner submits that the entire accusation is absurd and the petitioner has been implicated in false manner. It is further submitted that the petitioner has clean antecedent and is in custody since 7.6.2017. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siwan Town P.S.
