JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Dumariya P.S. Case No. 4 of 2006 for offences registered under Sections 147, 148, 149, 324, 342, 332, 333, 307, 427, 436 and 120(B) of the Indian Penal Code, Section 27 of the Arms Act, Sections 3/4 of the Explosive Substances Act and Section 17 of the C.L.A. Act.

Counsel for the petitioner submits that in the instant case similarly circumstanced other co-accused having similar allegation have already been granted bail. In fact, in the instant case, the petitioner has been implicated only on suspicion and there is no specific allegation of any overt act against the

Patna High Court Cr.Misc. No.44313 of 2017 (2) dt.21-09-2017 petitioner. Counsel for the petitioner has drawn my attention towards paragraph-3 of the petition that the petitioner has got no criminal antecedent.

Considering the fact that similarly circumstanced other co-accused having similar allegation have been granted bail by this Court vide order passed in Cr. Misc. No. 36117 of 2007 on 17.08.2007, Cr. Misc. No. 28017 of 2008 on 14.08.2008, Cr. Misc. No. 15009 of 2007 on 05.04.2007, Cr. Misc. No. 7583 of 2007 on 21.03.2007, Cr. Misc. No. 2043 of 2008 and Cr. Misc. No. 13687 of 2016, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in Dumariya P.S. Case No. 4 of 2006, subject to the conditions that one of the bailors should be the family members of the petitioner, the petitioner will extend full cooperation in conclusion of trial and will not tamper with the evidence or influence the witnesses.
