JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2022 The writ petition has been filed seeking the following relief :- "1. That the present writ petition is being filed for issuance of appropriate writ/writs, order/orders, direction/directions to the respondents authorities in the nature of Mandamus for direction to respondents to remove the encroachment made by the private respondents over the public Land (Rasta) in village Dhoai, Gauritol, P.S+Anchal- Sadar,

Patna High Court CWJC No.4893 of 2022(2) dt.28-11-2022 2/2 District - Darbhanga, which is Public Land (Road) for general Public (villagers)."

At the outset, the learned counsel for the petitioner submits that for removal of the encroachment in question, an encroachment case bearing Encroachment Case No. 02 of 201920 has already been initiated by the Circle Officer, Sadar, Darbhanga, i.e. the respondent no. 3 and now, he is only required to issue appropriate directions for removal of the encroachment in question.

Having regard to the limited grievance of the petitioner, I deem it fit and proper to grant liberty to the petitioner to approach the respondent no. 3, for redressal of his aforesaid grievances, whereupon the respondent no. 3 shall take appropriate action, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
