2. The petitioner apprehends arrest in connection with Jagdishpur P.S. Case No. 4 of 2024 instituted under Section 30(a) of the Excise Act.
3. The petitioner is the owner of the motorcycle from which the recovery of 24 litres of illicit liquor has been made. The motorcycle was taken by co-accused Sashi Kumar, who has been caught on the spot. The petitioner claims clean antecedent.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event

No.16174 of 2025(2) dt.02-04-2025 2/2 of arrest or surrender before the Court below within six weeks from today, the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 1, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 4 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
6. At the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.
