Claim made in the instant writ proceedings is for grant of benefits under first and second ACP. The petitioner has placed reliance on the grant of same benefits to one Arun Kumar Srivastava and claimed parity in the matter of grant of benefits under ACP schemes. The respondents have filed counter affidavit and their specific stand is that the persons who were appointed as Demonstrator before 1.4.1973 and granted benefit of UGC pay scale w.e.f. 01.01.1986, were not entitled for benefit of ACP. The benefit granted to Arun Kumar Srivastava has also been withdrawn. The petitioner's claim for parity

Patna High Court CWJC No.13566 of 2014(2) dt.16-07-2019 2/2 therefore, is misconceived as the benefit has also not been granted to Arun Kumar Srivastava and the averments made in the counter affidavit have not been denied or disputed till date. The writ petition is devoid of merit and the same is dismissed.
