JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and the State. The present application has been filed for quashing of the order dated 02.12.2013, passed by the learned CJM, Muzaffarpur, in Town P.S. Case No.101 of 2013, whereby the process has been directed to be issued after cognizance being taken for the offences punishable under sections 341, 323, 379 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner very fairly submits that the trial has commenced and witnesses have been examined, hence, prays for withdrawal of the application with a liberty to raise all the contentions at the appropriate stage of proceeding.

Patna High Court Cr.Misc. No.24997 of 2015 (2) dt.08-05-2017 Permission is accorded.

Accordingly, the application is disposed of as withdrawn.
