The petitioner is in custody in connection with Motihari Town P.S.Case No.573 of 2017 registered for an offence under Sections 387 and 120B of the IPC.

It has been submitted that the case was initially registered against unknown person on the allegation that a demand of ransom was made over his mobile. He further submits that the name of this petitioner appeared in the statement of one coaccused Atul Kashyap who simply stated that this petitioner had knowledge about the demand of ransom from the informant. The other co-accused Pappu Singh @ Pappu Financer @ Anand Kr. Singh whose name appeared in the confession of said accused has been allowed bail in Cr.Misc.No.57253 of 2017. The petitioner has

Patna High Court Cr.Misc. No.1553 of 2018 (3) dt.18-01-2018 2/2 clean antecedent except the four cases in which the petitioner was implicated on the basis of said confession. The petitioner is in custody since 12.09.2017.

The learned APP opposed the submissions.

Considering the case of this petitioner on better footing to the accused who has enjoyed the privilege of bail, the prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Motihari, East Champaran in connection with Motihari Town P.S.Case No.573 of 2017 subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
