The petitioner seeks bail in a case instituted under Section 35(a) of Bihar Prohibition and Excise Act, 2016 and 25(1-b)a/26 of the Arms Act.

It is alleged that 2 litres of foreign liquor and one one country made pistol with one live cartridge is said to have been recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.08.2017. There is no allegation of tampering of witnesses alleged against the petitioner. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna, in connection with Special Case No. 4561 of 2017, arising out of Digha P.S.
