JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302,307 and 120B/34 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that co accused Chanchal Kumar, Ranjeet Singh, Vikram Kumar, Sonu Kumar, Guddu alias Prashant Kumar and Ashik Kumar resorted to indiscriminate firing causing injury to the brother of the informant and the sister in law (Bhabhi). Subsequently, the sister in law of the informant succumbed to the injury. The motive for the occurrence alleged to be the nephew of informant marrying a co villager Bharti Kumari though the victim in her statement under section 164 Cr.P.C. stated that she married with the nephew of the informant of her own. This petitioner and others gave life threatening during the said episode.

No.25105 of 2015 (2) dt.10-07-2015 2/2 Considering the fact that the accusation of firing is not against the petitioner and statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Runni Saidpur P.S. Case No. 501 of 2014 pending in the court of learned C.J.M., Sitamarhi. This application is disposed of with the aforesaid observation/direction.
