The petitioners apprehend their arrest in Piro (Hasan Bazar) P.S. Case No. 18 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the petitioners were opening door towards the land of the informant and on protest all the accused persons assaulted her.
It is submitted that the occurrence took place due to land dispute. The petitioner filed petition on which proceeding under Section 107 of the Cr.P.C. was initiated. Earlier the informant filed Piro (Hasan Bazar) P.S. Case No. 349 of 2013
Patna High Court Cr.Misc. No.13670 of 2015 (3) dt.22-05-2015 2/2 under different Sections of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST Act against the Sarpanch of Gram Panchayat. The informant being Deputy Sarpanch of the Gram Panchayat she is in the habit of filing cases. The injury is simple in nature.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in Piro (Hasan Bazar) P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
