The petitioner is in custody since 05.08.2017 in connection with Jogbani (Bathanaha) P.S. Case No. 119 of 2017 for the offence registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that he is not named in the first information report but subsequently, on the basis of the confessional statement made by one Kanhaiya Kumar Sharma, the petitioner has been taken into custody. It is further submitted that there is no recovery from the conscious possession of the petitioner and till date no T.I. parade has been conducted. Considering the aforesaid facts and circumstances of

No.58925 of 2017 (2) dt.14-12-2017 2/2 the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Jogbani (Bathnaha) P.S. Case No. 119 of 2017.
