Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 399, 402 and 414 of the Indian Penal Code and section 25(1-b)a, 26 and 35 of the Arms Act.

As per the allegation, 7 unknown miscreants started to flee away but 3 miscreants were apprehended by the police and they disclosed the name of the petitioner, Gaurav Kumar who was fled away from the spot.

Learned counsel for the petitioner has submitted that the

No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner is also accused in one more criminal case as stated at para 3 of the bail petition. Learned counsel for the petitioner has further submitted that the co-accused person, Ashish Kumar has already been granted bail by a Coordinate Bench vide order dated 11.04.2022 passed in Cr. Misc. No. 53743 of 2021. The petitioner is in custody since 23.11.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-19th, Muzaffarpur, in connection with Sessions Trial No. 334 of 2021 arising out of Katra P.S. Case No.93 of 2021.

The application stands allowed.
