The matter has been taken up through video conferencing.

The petitioner apprehends his arrest in Bhagwan Bazar P.S. case No. 510/2019 registered under Section 147, 148, 149, 447, 323, 324, 307, 504 of the IPC.

The informant named as many as nine persons and alleged that they having armed with different weapons came. Ravi Kumar Sah, the petitioner, is alleged to have assaulted the informant with Daab on his head. Other accused persons also assaulted the informant and his family members. The learned counsel for the petitioner submits that there is counter version being Bhagwan Bazar P.S. case No. 511/2019. The informant got one lacerated wound on left side

Patna High Court CR. MISC. No.15232 of 2020(2) dt.07-09-2020 2/2 parietal region and nature of injury appears to be superficial and simple as the same is of 1"x1/2"x1/2" but on account of assault made by the informant and others father of the petitioner got grievous injuries. Many persons from the side of petitioner got grievous injuries. It is further submitted that final injury report has not yet been received.

Taking into consideration the facts that there is case and counter case and the informant got only one injury said to have been caused by the petitioner but the injury appears to be superficial and simple in nature, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. case No. 510/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
