The petitioner, in the present case, is seeking regular bail in connection with Arwal P.S. Case No.199 of 2017, registered for offences alleged under Sections 307, 353, 153(A), 379, 452, 427, 337, 341, 342, 323, 324, 504, 506, 120B, 188, 2147, 148 and 149 of the Indian Penal Code.
It is submitted by learned senior counsel for the petitioner that the petitioner has been falsely implicated in the present case as he is said to be a member of the mob. The case has been lodged against large number of persons on the allegation that they had participated in pelting stones and were damaging the shops. It is submitted that no overt act has been alleged against
Patna High Court Cr.Misc. No.328 of 2018 (2) dt.12-01-2018 this petitioner. He further submits that other similarly situated coaccused have been granted privilege of bail by different coordinate Bench of this Court vide Cr.Misc.No.57394 of 2017 and Cr.Misc.No.60173 of 2017 as contained in Annexure-2 series to the supplementary affidavit.
Learned APP opposed the prayer for bail.
Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal in connection with Arwal P.S. Case No.199 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
