Petitioners are in custody in connection with Manjhi P.S. Case No. 368 of 2019 for the offence under section 30, 30(a), 38(i)(ii) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that petitioners have no criminal antecedent. He further submits that other co-accused have been granted bail.
In this case total 1147.200 liters of foreign liquor was seized from a truck.
Learned counsel appearing on behalf of the petitioners submits that petitioners are driver and khalasi of the seized
Patna High Court CR. MISC. No.14847 of 2020(3) dt.29-05-2020 2/2 truck.
The petitioners are in custody since 10.12.2019. Considering the fact that other co-accused have been granted bail and the petitioners having no criminal antecedent have remained in custody for more than six months, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum- Special Judge,Excise, Saran, in connection with Manjhi P.S. Case No. 368 of 2019.
