The present matter has been listed out of turn on the mentioning slip filed on behalf of the petitioner stating therein that the elder brother of the petitioner has died on 05.09.2021 and there is none to look after the family members. Let the mentioning slip filed on behalf of the petitioner be kept on the record.

Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks from the date of restoration of normalcy. The petitioner is apprehending his arrest in connection with Hajipur Town P.S. case No.397/2020 registered under

Patna High Court CR. MISC. No.27194 of 2021(2) dt.14-09-2021 2/3 Sections 147, 148, 341, 323, 307 of the Indian Penal Code. Later on, Section 302 of I.P.C. has been added. Allegation is that the accused persons including the petitioner assaulted the husband of the informant by means of lathi, danda. When the informant and her daughter came to save him, they were also assaulted by the accused persons. The injured were taken to the Hospital for treatment. During course of treatment the husband of the informant died. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner.

The present case is outburst of the case instituted by the petitioner side three days prior to the alleged occurrence. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on his personal bond to the satisfaction of learned C.J.M.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of eight weeks to the satisfaction of the court concerned in connection with the aforesaid case.
