Heard learned counsel for the petitioner and learned A.P.P. for the State, Ms. Gulnar Begum. 2.

Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1, (Lalan Sahani), who was arrested during pendency of the instant anticipatory bail application. 3.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 1, (Lalan Sahani).

The petitioner no. 2 apprehends his arrest in a case registered for the offences punishable under Sections 126(2),

Patna High Court CR. MISC. No.17892 of 2026(2) dt.14-05-2026 2/3 115(2), 118(1), 303(2), 352, 351(3) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his agnates were constructing a house on his land, on objection, Lalan caught him from behind while petitioner no. 2 assaulted him by lathi causing injury on head and Sukesh assaulted him by lathi on his back, further Gyanti and Lalan also assaulted him by lathi and the injured was taken to hospital. 7.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that even presuming what has been alleged is true without admitting then the blow is not alleged to have been repeated and the injury has been opined to be simple in nature and petitioner is not a criminal.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioners, the petitioner no. 2 above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail
