Mr. Bisheshwar Ram, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner seeks bails in connection with Raniganj P.S. Case No. 189 of 2016 registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case, as lodged by the informant, an employee of Bandhan Bank is that while he along with one of his associates was returning after collecting money, was intercepted by four persons in two motorcycles, on gun point they snatched the collected money of Rs. 46,474/- and also took away mobile of the informant.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, not named in the First Information Report and his name surfaced

Patna High Court Cr.Misc. No.38870 of 2018(2) dt.10-07-2018 2/3 only on the confessional statement of co-accused, Niraj Kumar who has already been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 3758 of 2017 vide order dated 10.02.2017. He further submits that no Test Identification Parade has been done so far, nothing has been recovered from the possession of the petitioner and is languishing in judicial custody since 07.04.2018. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Raniganj P.S. Case No. 189 of 2016, subject to the conditions that:

(1) One of the bailors would be close relative of the petitioner having sufficient immovable properties, who will file an affidavit stating his relationship with the petitioner.

(2) The petitioner will appear before

Patna High Court Cr.Misc. No.38870 of 2018(2) dt.10-07-2018 3/3 the learned Court below during trial as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.

(3) It is also made clear that if, in future, petitioner indulges in an offence of similar nature, the prosecution will be at liberty to move the learned Court below for cancellation of his bail bonds.
