Petitioner no.1 being husband of the informant and petitioner no.2 being neighbor of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 380, 497, 498A and 504/34 of the Indian Penal Code.
Basic accusation is of torture. It is also alleged that petitioner no.1 has illicit relationship with petitioner no.2 Tuniya Devi and at the behest of Tuniya Devi petitioner no.1 used to assault the informant.
The filing of bail applications by the husband of the informant i.e. petitioner no.1 along with petitioner no.2 Tuniya
Patna High Court Cr.Misc. No.22195 of 2016 (2) dt.17-05-2016 2/2 Devi before the learned Court below and before this Court justify the accusation levelled by the informant.
In that view of the matter, let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Katihar Muffasil P.S. Case No.30/2016, pending before the learned Judicial Magistrate, 1st Class, Katihar. With the above observation, this application is, accordingly, disposed off.
