This application is for grant of regular bail in connection with Chand P.S.Case No.236 of 2018 for the offences under Sections 302/201/34 of the Indian Penal Code. Prosecution story is of recovery of the dead-body of the brother of the informant from a well and it is also said that the petitioner had gone to the house of the petitioner and stayed there in the night, thereafter the dead body was recovered on the next day.

Submission of the learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and later on statement of the informant has been recorded under Section 164 Cr.P.C, in which he has stated that he has lodged FIR only on the instruction of the villagers.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Chand P.S.Case No.236 of 2018. With the above direction, this application is allowed.
