Petitioner is in custody in connection with Kharik P.S. case No. 108 of 2019 for the offence under sections 147, 341, 323, 448, 354, 379, 504, 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the petitioner and the informant are next door neighbour and there is land dispute between the parties for which Title Suit No. 96 of 2019 is pending in the court of learned Munsiff, Naugachia.
Learned counsel submits that there is general and omnibus allegation against the petitioner and similarly circumstanced accused namely, Prakash Yadav has been granted
Patna High Court CR. MISC. No.20710 of 2020(3) dt.31-08-2020 2/2 bail by a coordinate bench of this Court in Cr. Misc. No. 82805 of 2019 on 14.1.2020.
Considering the fact that petitioner has no criminal antecedent and there is land dispute and he has remained in custody for nearly one year and similarly circumstanced accused has been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Naugachia, in connection with Kharik P.S. Case No. 108 of 2019.
