NILU AGRAWAL ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of the Accountant General, Bihar, Patna.
Petitioner in the present writ application prays for family pension current as well as arrears as the late employee Ram Narayan Mehra died in harness while being posted in the Agriculture Department. He submits that the family court in Maintenance Case No. 297 of 2013 dated 03.12.2016 had granted interim maintenance of Rs. 6000/- to the petitioner to be shared between the minor children.
Considering the nature of claim made by the
Patna High Court CWJC No.7359 of 2019(2) dt.22-04-2019 2/2 petitioner, petitioner is directed to file a detailed representation before the respondent no. 2, the Director, Department of Agriculture, Government of Bihar, Patna detailing all her claims and her entitlement which will be disposed of within a period of four months from the date of filing of such representation. Any amount due to the petitioner would be paid within two months thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.
