1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 329(4), 324(4), 326(g), 115(2), 109, 132, 221, 121(1) and 121(2) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that Md. Arif @ Lal Babu @ Arif Eqbal along with seven others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 77983 of 2025 and the same came to be allowed by an order dated 21.11.2025 passed by a learned Coordinate Bench. It is next submitted that case of the petitioner, if not akin, is similar to the case of Md. Arif and others. It is further submitted that informant in sum and substance alleges that accused persons including the petitioner got enraged after deceased person was
Patna High Court CR. MISC. No.18329 of 2026(2) dt.03-07-2026 2/3 declared dead at the hospital, as such, the accused persons assaulted medical staff and set an ambulance on fire, later on, their identification was established through video footage.
4. The Court has perused the allegations as alleged in the FIR and also the order dated 21.11.2025 in Criminal Miscellaneous No. 77983 of 2025 passed by a learned Coordinate Bench and finds that the case of the instant petitioner is similar to the case of Md. Arif and others.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dhaka P.S. Case No. 302 of 2024 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. The application stands allowed.
