The petitioner seeks bail in connection with Mal Salami P.S. Case No. 56 of 2017 dated 06.04.2017 instituted for the offences under Sections 363, 302, 201 and 120(B) of the Indian Penal Code.

The son of the informant went out of the house for work but never returned. Later, his dead body was recovered. The deceased, at the time of leaving his house, was carrying a mobile telephone. With respect to the aforesaid mobile number and the IMEI Number of the phone, one Rajkumar was arrested. Aforesaid Rajkumar disclosed that the concerned mobile was made available to him by one Sanjay Kumar who happens to be one of the friends of the petitioner.

Patna High Court Cr.Misc. No.49660 of 2017 (3) dt.05-12-2017 Learned counsel for the petitioner submits that Rajkumar and Sanjay Kumar have some enmity with the petitioner and therefore, unnecessarily he has been named in this case. The petitioner does not bear any criminal antecedent. Regard being had to the fact that the petitioner does not have any criminal antecedent and he is in custody since 17.06.2017, this Court is inclined to grant bail to him. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Patna City in connection with Mal Salami P.S. Case No. 56 of 2017.
