SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 307, other allied Sections of the Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Petitioner is said to have assaulted the sister of the informant causing her abortion, which is disputed with reference to Annexure-2, report of Muskan Nursing Home indicating that the victim was subjected to sonography test on 05.11.2013 when fetus in her abdomen was found not moving. The occurrence is said to have taken place in the evening of 05.11.2013. Let petitioner surrender in the court below within

Patna High Court Cr.Misc. No.8157 of 2015 (3) dt.22-05-2015 2/2 four weeks from the date of receipt/production of a copy of this order in the court below and thereafter be released on bail on furnishing bond of Rs. 5,000/-(Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 246 of 2013, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
