Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A, 366, 504, 506 of the Indian Penal Code.

The accusation is kidnapping the minor sister of the informant.

It is submitted by learned counsel for the petitioner that petitioner has performed marriage with the victim and she is now pregnant. Moreover the victim has filed a petition before learned Court below claiming that she has married with the petitioner on 07.01.2015.

The petitioner is ready to produce the victim before learned Court below.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.26024 of 2015 (2) dt.02-07-2015 2/2 before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea in connection with Barhara(Raghubansh Nagar) P.S. Case No. 92 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Let the petitioner produce the victim girl before learned Court below on 27th of July, 2015 when learned Court below will record the statement of the victim. If the victim admits that she of her own married with the petitioner then provisional bail of the petitioner will be confirmed by learned Court below, otherwise the petitioner will surrender and pray for regular bail.
