That this is an application for issuance of a Writ in the nature of Mandamus commanding and directing the Respondents authorities to remove the encroachment made by the Respondent No. 4 upon the Public Village Road land pertaining to Khata No. 1441 Khesra No.

2633 situated in Mauza- Fatehabad, Thana N. 321, Anchal Paroo, DistrictMuzaffarpur total Area 019 decimals which is a Public Road and is being used by the petitioner as well as the other Covillagers but the Respondent No. 4 has illegally and forcibly encroached maximum part of the Public Road land

Patna High Court CWJC No.4436 of 2024(2) dt.20-06-2024 2/2 have constructed some illegal construction over the Road land in connivance with the Official Respondents."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Paroo, DistrictMuzaffarpur, for redressal of his aforesaid grievance. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Paroo, District-Muzaffarpur, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, the same shall be considered, in accordance with law and appropriate action shall be taken forthwith.

The writ petition stands disposed off on the aforesaid terms.
