The petitioner apprehends his arrest in a case registered under section 307 and other sections of the IPC and section 27 of the Arms Act.

The informant named the petitioner along with other accused persons and alleged that they came and started pulling down his wall. It is further alleged that Bikas Yadav, the petitioner, opened fire which hit his son Shailesh Yadav and when he went there to save his son, other accused persons also assaulted them.

It is submitted that there is a land dispute. The petitioner is alleged to have fired but the injury was found simple. The petitioner has also filed a complaint case against the informant and others.

Considering the facts aforesaid and nature of allegation that the petitioner fired causing injury to Shailesh Yadav, I am not inclined to enlarge him on anticipatory bail and accordingly,

Patna High Court Cr.Misc. No.34973 of 2014 (2) dt.13-03-2015 the same is rejected.

The petitioner is directed to surrender before the court below and pray for regular bail and the court below shall consider the same on its own merits without being prejudiced of this order (Prabhat Kumar Jha, J) ahk/- U T
