In this case earlier the bail of the petitioner was rejected l by this Court vide order dated 21.06.2017 in Cr. Misc. No. 9215 of 2017 with direction to expedite the trial and try to conclude the same within a period of three months on day-to-day basis and at the same time Superintendent of Police, East Champaran is also directed to ensure that witnesses were present in Court on the date fixed so as to conclude the trial within the specified time. Submission of the learned counsel for the petitioner is that the trial has not been concluded till date and he is
Patna High Court Cr.Misc. No.51059 of 2017 (3) dt.22-11-2017 2/2 in custody since 24.04.2017 and other accused persons have been granted bail.
Learned A.P.P. also opposes the prayer for bail and submits that after framing of charge, out of nine charged witness, only six witnesses have already been examined and rest three P.Ws. including I.O. are to be examined.
In view of above facts and circumstances three months' further time is granted to conclude the trial and if not concluded within time, the learned Trial Court shall release the petitioner to his own satisfaction.
