The petitioner apprehends his arrest in connection with Tilouthu P.S. Case No. 530 of 2013 registered for offences punishable under Section 379, 411, 120B of the Indian Penal Code and Sections 33, 41and 42 of the Forest Act and 40 of Bihar Mines Act.
It is submitted on behalf of the petitioner that he is alleged to be the driver of the concerned tractor and trailer loaded with stone chips. However, he was neither found at the spot nor near the tractor. It is further submitted that co-accused Upendr Yadav, who is owner of the tractor, has already been granted bail by a Bench of this Court by order dated 19.05.2014
Patna High Court Cr.Misc. No.35775 of 2014 (2) dt.11-02-2015 2/2 passed in Cr. Misc. No. 11270 of 2014.
Having regard to the facts and circumstances of the case, let the petitioner, namely Chandan Prasad, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Tilouthu P.S. Case No. 530 of 2013, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
