JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsel for the petitioners as well as learned A.P.P. for the State.

The petitioners, already in custody, seeks bail in connection with Siswan P.S. Case No. 07/2017, registered under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30 ( A)/38 (1) of Bihar Excise Act, 2016.

Learned counsel for the petitioners submits that there is no recovery from the possession of the petitioners rather the recovery was made from some other co-accused and the name of the petitioners appeared in the case on the disclosure made by one of the co-accused Raju Bin @ Raju Bind, who has already been granted bail by a Co-ordinate Bench of the Court vide order dated

Patna High Court Cr.Misc. No.3493 of 2018 (2) dt.30-01-2018 2/2 01.07.2017 passed in Cr. Misc. No. 28529 of 2017. It is also submitted that the petitioners have no concerned with the alleged illicit liquor trade and they have no criminal antecedents and are in custody since 12.10.2017.

Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- X, Siwan in Siswan P. S. Case No. 07/2017.
