JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,325,379,504 and 506/34 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that the possession of the land of the informant was taken by the accused persons where a proceeding under section 144 Cr.P.C. was initiated at the instance of the informant. It is further alleged that the informant was assaulted and the accused persons took away articles and jewellery from the shop of the informant though earlier also assault was made at the point of rifle.
Patna High Court Cr.Misc. No.32689 of 2014 (2) dt.13-02-2015 2/2 It is submitted by learned counsel for the petitioner that no injury has been caused to anyone. Statement to that effect has been made in the supplementary affidavit. It is further submitted that the accusation has been levelled admittedly in the background of serious land dispute.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati in connection with Dumariya P.S. Case No. 55 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
