The petitioner is languishing in custody since 27.10.2018 in a case registered for the offences punishable under Sections 272 and 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that from the house of the petitioner, 30 litres Indian made foreign liquor have been recovered.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house of the petitioner and the petitioner was not present in the house at the time of recovery.

Learned APP submits that recovery has been made from the house of the petitioner.

Case No.425 of 2018.
