JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner, learned A.P.P. as well as learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in Jamui Mahila P.S. Case No. 15 of 2016 under Sections 376/511 and 379 of the Indian Penal Code.

The prosecutrix alleged that the petitioner dragged her to a wheat field and made all attempts to outrage her modesty and thereafter the petitioner fled away from there. It is submitted that the case is lodged after seven days of the occurrence. There is no reasonable explanation for such delay.

On the other hand, learned counsel appearing on behalf of the informant as well as learned A.P.P. has opposed the prayer for anticipatory bail.

Patna High Court Cr.Misc. No.20726 of 2016 (3) dt.19-07-2016 2/2 The prosecutrix has very specifically stated that it was the petitioner who made all attempts to outrage her modesty and during the course of investigation, the witnesses also supported the story of the victim.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Jamui Mahila P.S. Case No. 15 of 2016. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
