The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the FIR, all the FIR named accused persons including petitioners entered the house of informant, ransacked and assaulted Saurabh Kumar and family members. Petitioner no. 2 took away bicycle and other accused persons snatched gold chain from the neck of Saurabh Kumar.

It is submitted that petitioners have been falsely

Patna High Court CR. MISC. No.17458 of 2022(2) dt.27-09-2022 2/2 implicated in this case due to admitted land dispute between the parties. Allegation of assault and snatching is general and omnibus. Both parties are next door neighbours. In fact, free fight took place between the parties due to land dispute in which both sides sustained injuries. There is case and counter case. Injuries sustained by the injured is simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Khagaria in connection with Parbatta P.S. Case No. 478 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
