Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the I.P.C and Section 30A of the Bihar Prohibition and Excise Act, 2016. Submission is that no excise material was recovered from possession of the petitioner rather name of the petitioner surfaced in the confessional statement of co-accused-Shubham Kumar @ Mannu Kumar. Petitioner is in custody since 13.02.2020. There is no material to substantiate that petitioner is going to tamper with the evidence or hamper the trial. Case No.05 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
