JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.5.2018, seeks bail in Nagar PS Case No. 320 of 2018 registered under Section 414/34 of the IPC.
The allegation in brief is that the petitioner and two other accomplice were apprehended by the police on the way ridding a motorcycle and it is alleged that the motorcycle is stolen one. Learned Counsel for the petitioner submits that it is not disclosed in the FIR or seizure list as to who was driving the motorcycle, the petitioner has clean antecedent, merely on the basis of confessional statement he has been implicated along with Madhuranjan Kumar and Prem Raj and they have purchased the said motorcycle from Prince Raj as disclosed by them. Having considered the said facts and circumstances, the petitioner, namely, Gulshan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nawada in connection with Nagar PS Case No. 320 of 2018.
