The present writ application has been filed by the
Patna High Court CWJC No.6537 of 2020(3) dt.09-08-2021 2/2 petitioner challenging the election of respondent No.13 on the post of Chairman of Harkhar (PACCS), Block-Khaira, District Jamui.
Learned counsel for the respondent No.1 and 2 submits that the petitioner has remedy under the Bihar Cooperative Societies Act, 1935 and relying upon Section 14(A) sub-Clause (6) of the Co-operative Societies Act, learned counsel submits that the election dispute can be raised by an aggrieved person by filing election petition before the Registrar, Cooperative Society under Section 48 of the Cooperative Societies Act, 1935.
In view of the submission made by learned counsel for the respondent No.1 and 2, learned counsel for the petitioner seeks permission to withdraw this writ application with liberty to file an election petition before the Registrar, Cooperative Society within a period of one month. Permission is accorded. Accordingly, this writ application is dismissed as withdrawn with the liberty aforesaid.
