The petitioner seeks bail in connection with Barachatti P.S. Case No. 92/2018 dated 02.02.2018 instituted for the offences under Sections 147, 148, 149, 212, 384, 386, 401, 427 and 435 of the Indian Penal Code read with Section 17 of the Criminal Amendment Act and Sections 3/4/5 of the Explosive Substance Act.
A machine was set on fire. When this information was provided to the police station, the Officer-Incharge of the concerned police station came to the spot and was told by the villagers that one Ashok Mahto might have had his hand in the aforesaid occurrence. A raid was conducted, when some of the miscreants could manage to flee away but one Sanjay Reddy was arrested. He
Patna High Court Cr.Misc. No.40329 of 2018 (2) dt.10-07-2018 2/2 disclosed the name of the petitioner also.
The learned counsel for the petitioner has submitted that at best, the material against the petitioner is only confession of a co-accused. He has further submitted that the petitioner does not have any criminal antecedent and is in custody since 19.02.2018. Under similar circumstances, it has been argued, some of the accused persons have been granted bail by different Benches of this Court.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 92/2018.
