====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in a case for the offence registered under Sections 302 and 201/34 of the IPC. The prosecution story, in brief, is that the informant performed the marriage of his younger daughter Jachni Devi with Nago Lal Deo, the son of petitioner no. 2. Nago Lal Deo used to live at Ranchi for his livelihood. The petitioners made an attempt to do away with the life of informant's daughter due to land dispute. Hence, his daughter also starting living at Ranchi with her husband. Co-accused Jeevan Lal Deo in collusion with the petitioners went to Ranchi and brought Jachni

Patna High Court CR. MISC. No.14595 of 2020(2) dt.02-03-2020 2/3 Devi to her matrimonial house. On 02.08.2019, the informant received information that the petitioners alongwith co-accused killed his daughter by strangulating her and threw the dead body in a well near the Community Hall.

It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 02.08.2019. The petitioners have got no criminal antecedent. They have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The name of the petitioners has come in the present case merely on the basis of suspicion. Neither there is eye witness to the alleged occurrence nor there is circumstantial evidence to suggest the participation of the petitioners in the alleged occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge, Darbhanga, in connection with S.T.
