JUSTICE RAVI RANJAN ORAL ORDER 22-05-2015 Learned counsel for the petitioner submits that the petitioner had submitted his tender papers in response to the notice inviting tender as contained in Annexure-1, however, the respondent nos.5, 6 and 7 has been shown to be successful and no intimation was given to him indicating the reasons, due to which his tender application has been rejected.

It is submitted that he has approached the District Magistrate-cum-Chairman of the District Health Committee,

Patna High Court CWJC No.6741 of 2015 (2) dt.22-05-2015 2/2 Kaimur, Bhabhua by filing a representation, which was duly received by his office, requesting him to intimate the grounds on which he has been declared disqualified, however, nothing has been intimated till date.

In above view of the matter, this writ application is being disposed of with a direction to the District Magistrate, Bhabhua to supply the necessary information regarding disqualification of the petitioner within a period of two weeks from the date of receipt/production of a copy of this order. Petitioner would also be at liberty to file further representation to the District Magistrate regarding alleged disqualification of the respondent nos.5, 6 and 7 and, if such application is filed, let a decision be taken by him within a period of four weeks from the date of filing of the same. However, it is made clear that this Court has not expressed any opinion with regard to correctness of the allegation of the petitioner, and, thus, a decision shall be taken only after granting reasonable opportunity to all the concerned.
