Petitioner seeks regular bail in connection with Bandeya PS Case No. 15/2022 registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise (Amendment) Act 2018.

The police on the basis of secret information that the petitioner along with one another accused person have kept illicit liquor in the field near palm tree for selling the same, proceeded towards the place of occurrence and recovered 105 litres of Indian made illicit liquor and 28.125 litres of wine. The petitioner was also arrested.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of suspicion. Learned counsel further submits that no illicit liquor

No.17538 of 2022(2) dt.25-05-2022 2/2 has been recovered from the conscious possession of the petitioner rather the same has been recovered from a field near palm tree which is an open space accessible to all and sundry. The petitioner is in custody since 07.03.2022. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that no illicit liquor has been recovered from the conscious possession of the petitioner rather the same has been recovered from a field near palm tree which is an open space accessible to all and sundry and the petitioner is in custody since 07.03.2022 , I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX-cumSpecial Judge, Excise Act-II, Aurangabad (Bihar) in connection with Bandeya PS Case No. 15/2022.
