The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Rajeev Nagar P.S. Case no. 527 of 2018 instituted for the offence punishable under Section 376 of the Indian Penal Code. As per allegation in the FIR, marriage negotiation between the parents of petitioner and the informant failed, they tried to solve the problems which were coming in their marriage, they planned a meeting, in which petitioner had established physical relationship with the informant on the pretext of marriage to which later on he denied. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no
Patna High Court CR. MISC. No.27251 of 2021(5) dt.11-07-2022 2/2 offence. Only with a view to put pressure of marriage, informant has lodged a false case with concocted story. It is unbelievable that petitioner would have established physical relation without her consent still she kept mum. She even did not inform the matter to the Hotel management. It is further submitted that informant is a major lady.
Learned APP appearing for the State has opposed the prayer of Bail and submitted that informant has supported the prosecution version in her restatement.
Having heard learned counsel for the parties and taking into consideration that there is direct allegation against the petitioner, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected. (Sunil Kumar Panwar, J) sushma/- U
