2. The petitioners are apprehending their arrest in connection with Jagdishpur P.S. Case No. 417 of 2023, dated 04.10.2023 for the offences punishable under Sections 147, 341, 323, 307, 504, 506 of the Indian Penal Code.
3. As per prosecution case, the petitioners and five others unknown persons are alleged to have assaulted the informant. The petitioners assaulted the informant by means of lathi and rod due to which informant sustained head injury and
Patna High Court CR. MISC. No.18648 of 2024(2) dt.01-04-2024 2/3 became unconscious.
4. Learned counsel for the petitioners has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. There is no specific allegation against the petitioners rather the allegation is general and omnibus in nature. Learned counsel further submitted that a compromise has taken place between both the parties dated 31.10.2023 mentioned in para 14 of the bail petition. As per impugned order, the injury received by the informant is kept reserved.
5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioners, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Bhojpur in connection with Jagdishpur P.S. Case No. 417 of 2023, subject to conditions as laid down under Section
Patna High Court CR. MISC. No.18648 of 2024(2) dt.01-04-2024 3/3 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
