No one appears on behalf of the State.

Lodged in the jail custody in connection Ekma P.S. Case No.63 of 2017 registered under sections 413 and 414 IPC and diverse penal provisions of the Arms Act, the petitioner has prayed for grant of bail.

In course of checking, it is alleged that he was found in possession of a motor-cycle and one country-made loaded pistol with one cartridge. The motor-cycle driven by him was also allegedly stolen one.

Learned counsel for the petitioner submits that there is no FIR with regard to the theft or robbing of the motor-cycle. He further states that the petitioner was falsely implicated in this

Patna High Court Cr.Misc. No.50893 of 2017(2) dt.09-11-2017 2/2 case on different reasons. He is in custody since 27.03.2017 having no criminal antecedents.

Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Saran at Chapra in Ekma P.S. Case No. 63 of 2017 on condition that one of the bailors shall be his own/close family member. As soon as the charges are framed, he shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds and secure his arrest in accordance with law.
