The petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant and disposing of the dead body by the in-laws.
It is submitted by learned counsel for the petitioner that the FIR neither stipulates the date of marriage nor there is any accusation of demand of dowry, hence, even assuming the accusation no offence under Section 304B of the
Patna High Court Cr.Misc. No.20033 of 2016 (02) dt.05-05-2016 2/2 IPC is made out. The accusation is omnibus and general. The informant is not the eye witness to the occurrence and considering the above facts, the brother of the husband of the victim has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 13972 of 2016. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 06 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
